Texas Penalties for Drug Sales

Penalties will be based upon the type of drug, the quantity of the substance, whether the sale occurred in or near school grounds, and whether the offender has a prior criminal record. Sentencing can range from 1 year to as long as a life sentence. There are mandatory penalties for some crimes, as long as 5 years. You also run the risk of having some or all of your assets seized and forfeited, as well as losing your legal right to drive.

According to Texas law, drug penalties are based on the weight of drugs. Drugs can be divided into penalty groups with the goal of determining what felony and punishment will be charged.

For penalty group 1 (PG1) drugs such as heroin, cocaine, methamphetamines, etc., the penalty range includes:

  • < 1 gram: state jail felony; penalties include up to 2 years in jail & up to $10,000 in fines
  • 1-4 grams: 2nd degree felony; penalties include 2-20 years & up to $10,00 in fines
  • 4-200 grams: 1st degree felony; penalties include 5-99 years & up to $10,000 in fines
  • 200-400 grams: 1st degree enhanced felony; penalties include 10-99 years in prison & up to $100,000 in fines
  • 400 grams or more: 1st degree enhanced felony; penalties include life in prison or 15-99 years & up to $250,000 in fines
